Research on Migrant Workers

SUHAKAM has been tasked to prepare and compile a research report on "Migrant Workers and Undocumented Persons" during the First Meeting on ASEAN National Human Rights Institutions Consultation Mechanism, which was held in Bangkok on 19 October 2004. Thus, the Human Rights Commission of Malaysia spearheads the research project on migrant workers under the Framework of Cooperation of the ASEAN NHRI Forum.

The table below presents the objectives of this project from the perspectives of both sending and receiving countries that are affected with human rights issues on migrant workers, to wit:

Sending Countries

Receiving Countries

  • To find out problems faced by migrant workers, e.g. why do so many migrant workers come to receiving country without proper documents; why so many of them are deceived by recruiting agents.
  • To obtain data on the status of migrant workers and undocumented persons in Malaysia
  • To establish and promote practices to regulate recruitment of migrant workers.
  • To research into international laws and regulations pertaining to the legal recruitment, working conditions, remunerations & wages, healthcare, housing, welfare of migrant workers.
  • To ensure that outflow workers receive proper skills training.
  • To find out methods to mitigate human rights violations of migrant workers such as violence against migrant workers.
  • To advocate for appropriate legislation for screening and recruitment of workers as well as mechanism to ensure workers have skills and good physical and mental health.
  • To make recommendations to the    government on legislations, policies and practices pertaining to issues of migrant workers to ensure human rights are upheld.
